1. Practice Supplier Identification (ECTA § 43)

In terms of Section 43 of the Electronic Communications and Transactions Act No. 25 of 2002 (ECTA), our full statutory practice credentials and supplier disclosures are as follows:

Dr Larisha Pather conducts clinical medical aesthetics, anti-aging therapies, and medical weight management strictly by prior appointment from Netcare Parklands Hospital, Suite 2:

• Pre-Treatment Physical Assessment: All invasive or injectable treatments (including Botulinum Toxin, Dermal Fillers, and Medical Weight Management) require an initial physician consultation to assess clinical suitability, review contraindications, and develop an individualized treatment roadmap.
• Booking Confirmation: Appointments may be requested via WhatsApp, telephone, or authorized booking widgets. Bookings become confirmed once practice availability is formally verified by our reception team.
• Age Requirement: Clinical aesthetic procedures are restricted to individuals aged 18 years and older. Consultations for minors (e.g. dermatological acne management) require the physical presence and signed informed consent of a parent or legal guardian.

3. Cancellation & Reschedule Policy

As a private physician practice with reserved theater and consultation suites, Dr Larisha allocates dedicated medical time for each patient. We respectfully enforce the following cancellation terms:

• Minimum Notice Period: A minimum of 24 (twenty-four) hours' notice is required to cancel or reschedule a scheduled appointment without penalty.
• Late Cancellations & No-Shows: Cancellations made less than 24 hours prior to the scheduled time, or non-attendance without notice, may attract a late cancellation fee equivalent to the base consultation fee (R500) to cover reserved theater and clinical staffing costs.
• Emergency Circumstances: We understand that acute medical or personal emergencies arise. In documented acute emergencies, the late cancellation fee may be waived at Dr Larisha's sole clinical discretion.

4. Physician Administration & Informed Consent

All clinical aesthetic procedures (including BTOX anti-wrinkle injections, lip filler contouring, metabolic lipolysis, IV nutritional wellness drips, and medical chemical peels) are personally administered by Dr Larisha Pather (MBChB):

• Zero Delegated Injections: Procedures are never delegated to unqualified technicians, aesthetic assistants, or non-medical staff.
• Medical Products: Only authentic, CE-marked and SAHPRA-compliant premium pharmaceuticals and biocompatible medical devices are utilized. Each vial or syringe lot number is recorded in the patient's permanent clinical chart.
• Physical Informed Consent: Prior to treatment administration, patients receive comprehensive verbal and written disclosure regarding expected outcomes, potential common temporary side effects (such as mild erythema, localized swelling, or transient bruising), rare risks, and post-procedure care protocols. Treatments proceed only after the patient executes a signed informed consent agreement.

5. Individual Clinical Outcomes & Disclaimers

Medicine and aesthetic rejuvenation are biological sciences. Individual anatomical response, metabolic breakdown rate, skin elasticity, lifestyle factors (such as smoking, UV exposure, and hydration), and physiological predispositions vary significantly between individuals:

• No Guarantee of Identical Outcomes: While Dr Larisha utilizes gold-standard medical techniques, results cannot be guaranteed to duplicate any particular visual result, reference photograph, or third-party patient outcome.
• Touch-Ups & Top-Ups: Neuromodulator treatments are reviewed at approximately 14 days post-administration. Any additional units requested beyond the agreed clinical plan will be billed according to standard per-unit pricing.
• Emergency Hospital Base: In the rare event of an unexpected acute medical reaction, the practice is physically integrated within Netcare Parklands Hospital, providing immediate physician care and access to 24/7 hospital casualty support.

6. Skincare Boutique E-Commerce (CPA & ECTA Compliance)

Our online Serene Skincare dispensary allows patients and clients to purchase physician-formulated active skincare formulations for home care:

• Pricing & Currency: All prices displayed on our website are denominated in South African Rand (ZAR) and are inclusive of standard Value Added Tax (VAT) where applicable.
• Product Authenticity: All formulations are authentic, freshly compounded, and dermatologically tested for South African UV conditions and Fitzpatrick IV–VI melanin-rich skin.
• Payment Facilities: We support flexible, secure payments including Payflex (4 interest-free equal instalments paid over 6 weeks), major debit and credit cards, and verified Instant EFT. All electronic transactions are processed through encrypted, PCI-DSS certified South African gateways.
• Order Review Step: In terms of Section 43(1) of ECTA, customers are provided with a complete summary of items, quantities, shipping fees, and total costs prior to final order confirmation.

7. Courier Dispatch & Delivery Terms

We partner with premier South African logistics provider The Courier Guy for nationwide order fulfillment:

• Dispatch Turnaround: Orders confirmed and paid before 12:00 (Monday to Friday) are typically packed and dispatched within 24 to 48 hours. Orders placed over weekends or public holidays are dispatched on the next working business day.
• Delivery Timelines: Standard road courier delivery across major South African metropolitan centers (Durban, Johannesburg, Pretoria, Cape Town) takes approximately 2 to 4 working days. Outlying or regional rural destinations may take up to 5 to 7 working days.
• Free Shipping Threshold: All qualifying skincare orders with a basket value of R1 200.00 (one thousand two hundred Rand) or more qualify for free standard courier delivery anywhere in South Africa.
• Delivery Inspection: Upon delivery, recipients must inspect the exterior courier packaging. Any apparent physical tampering, crushing, or leakage must be noted on the courier's electronic proof of delivery receipt and photographed immediately.

8. Statutory Cooling-Off Rights & Return Policy

Under Section 44 of ECTA and Section 55 and 56 of the Consumer Protection Act (CPA):

• 7-Day Distance Cooling-Off Period: You are entitled to cancel your electronic skincare purchase without reason within 7 (seven) calendar days of receiving delivery, provided that the product packaging remains completely unopened, uncompromised, in its original sealed box, with all protective seals intact. Return courier fees for voluntary cooling-off cancellations are borne by the consumer.
• Health & Hygiene Exemption: In terms of Section 55 of the CPA and public health safety standards, active clinical skincare products (such as serums, face creams, and eye treatments) whose tamper-evident seals or pump dispensers have been opened, broken, or tested cannot be returned, refunded, or exchanged once unsealed, due to hygiene and microbiological contamination risks.
• Defective, Broken, or Incorrect Shipments: If you receive an item that is damaged in transit, defective, or incorrect, please notify our team within 7 (seven) days of receipt at info@drlarisha.co.za with your order number and clear photographs. We will arrange collection at our expense and provide a prompt replacement or full refund.

9. Governing Law & Jurisdiction

These terms and conditions, your use of this website, and all agreements entered into with Dr Larisha Pather are governed exclusively by the laws of the Republic of South Africa.

You consent to the exclusive jurisdiction of the Magistrates' Court or the High Court of South Africa (KwaZulu-Natal Division, Durban) in respect of any dispute arising out of or in connection with these terms, subject to our mutual commitment to first resolve disputes amicably through good-faith mediation.
